Georgia law provides that a court
is supposed to be gender neutral when evaluating custody and
visitation issues.
Instead, Georgia courts are required to
evaluate a long list of factors to decide what is in the best
interest of the child.
These factors range from evaluating the
ties each parent and his or her siblings have with the child to the
capacity and disposition of each parent to best raise a child.
Because of the long list of factors
involved, the complexity in weighing various factors, and stakes
involved, it is strongly recommended that you consult with an
attorney if custody and visitation issues are at issue in your
divorce.
Particularly when it comes to these types of issues, it is our
philosophy that, whenever possible and appropriate, the parties
should work together towards a mutually agreeable child custody and
visitation schedule that provides liberal visitation in the best
interest of the children. Even when these types of
efforts fail, we believe that it is important to attempt to resolve
any differences that remain between the parties using a mediator to
assist the negotiations to try and determine if an arrangement that
can be reached that both parents are willing to accept, and most
importantly, a win for the children who are caught in the middle of
the dispute.
In cases where these types of
efforts fail, judges frequently appoint an outsider to evaluate the
situation and to represent the children during this process.
This person, typically an attorney, is
called a Guardian ad Litem.
Guardians will give a recommendation to
the court as to what would be in the “best interest of the children”
in regards to a custody and visitation arrangement. In certain
situations, a custody evaluator can be appointed to develop an
expert opinion as to which parent would be the best primary
custodian for the children.
Child custody disputes can be some of the
most difficult family law cases.
